1. AGREEMENT

1.1 These Terms and Conditions and the Booking Form constitute the Agreement between you (the guest) and the owners of the property Your Exclusive Stay (YES) arranges short term rentals of properties as agents of the owners of the properties. This Agreement will be entered into once the guest’s deposit has been processed. YES will confirm the booking by sending the guest a booking confirmation.
1.2 The person who enters into this booking and completes the booking form certifies that he or she has the consent and authority to do so and that the signatory is over 21 years of age.
1.3 The person who enters into the booking form is under a responsibility to ensure other party members comply with these Terms and Conditions and is wholly responsible for all payments in relation to this booking.

2. PAYMENT

2.1 For all bookings YES require a deposit payment of 30% of the total rent to confirm your booking. The balance becomes payable 12 weeks before the start of the rental.
2.2 Where a booking is made within 12 weeks of the start of the rental, the full rental amount must be paid. Failure to pay the balance on or before the due date shall be construed as a cancellation of the booking by the guest.
2.3 Payment can be made by electronic bank transfer, cheque, debit card, Visa or Mastercard (there is a 2.5% surcharge for payments made by credit card). All cheques to be made payable to ‘Your Exclusive Stay’.
2.4 All prices are inclusive of VAT at the current rate. Should the VAT rate change, we reserve the right to amend our prices accordingly.
2.5 A refundable cautionary damage deposit is held to cover any losses, damage and additional cleaning charges, if the property is left in an unsatisfactory condition. The guest hereby agrees to give authorization to deduct from the damage deposit the cost of replacement, repair or extra cleaning associated with any damage or breakage that takes place during the period of their stay. Upon a satisfactory inspection of the property this will be refunded to you within 7 days.

3. CANCELLATION

3.1 Any cancellation made by the guest for whatever reason must be made in writing and sent to YES. On receipt of the notice of cancellation, YES will endeavour to re-let the Property. If YES succeeds in re-letting the Property for the whole of the period booked it shall refund an amount equal to the money paid less an administration fee of £50. If YES is unable to re-let the property then all monies paid by the guest shall be forfeited to YES. We strongly recommend guests to take out cancellation insurance should they be in any doubt as to their ability to fulfil an existing booking commitment.
3.2 YES may consider a request from the guest to change the dates of the booking, agreement will be given subject to the property owner agreeing to the change and the request must be received in writing.

4. PERIOD OF HIRE

4.1 Rentals commence at 4.00pm on the day of arrival and terminate at 10.00am on the day of departure.

5. OCCUPATION OF THE PROPERTY

5.1 The number of guests occupying a property must not exceed the maximum number as stated for each property, with no additional guests allowed to visit. The property will be used for personal, domestic purposes only and cannot be sub-let to third parties. The property shall not be used for any commercial purposes without the prior consent of YES. YES reserves the right to refuse entry to the entire party if these conditions are not observed.
5.2 You and your guests must comply with any reasonable regulations relating to the property, such regulations will be communicated to you on your arrival at the property.
5.3 YES cannot accept any responsibility for any outside contractors and service providers and any damage YES will hold you responsible for any damage caused through negligence by you, your guests or contractors.
5.4 Where a property has a swimming pool and Jacuzzi, it will be maintained in accordance with acceptable standards and we advise guests to remove all jewellery prior to using the pool and Jacuzzi and to check with your hair stylist should your hair be chemically treated in any way. However, discolouration may occur in chemical treated hair and to some jewellery.

6. COMPLAINTS

6.1 Should there be any cause for complaint during the occupation of the property, please contact the property owner or housekeeper promptly during your stay. Owners will only investigate complaints which are notified to them during the guests stay as any dispute relating to the rental itself will be a matter directly between the guest and the owner.

7. CARE OF THE PROPERTY

7.1 By making a booking, the guest agrees to take full responsibility for all members of their group and to ensure that reasonable and proper care is taken of the property both internally and externally including the property’s contents. The guest agrees to keep the property clean and tidy throughout the rental and will leave it at the end of the rental in the same condition, state, and repair in which they found it on their arrival. Failure to meet this standard will result in a charge being levied against the damage deposit.
7.2 Any defects or breakages that become apparent to the guest at the start of the rental must be notified to the owner/house manager. Unless any such matters are reported, the guest accepts that the property was received in a clean and tidy condition and in good repair.

8. PETS

8.1 Pets are allowed by prior permission only and at the sole discretion of the owner. Pets must not be left unattended in the property and must be kept under proper control at all times and you will be responsible for any damage caused. Dogs are permitted at some properties as detailed on our website.

9. NO SMOKING POLICY

9.1 All YES properties operate a total no-smoking policy.

10. LIABILITY

10.1YES (for itself, its employees and agents) shall not be under any liability to the guests or third parties for any accident, damage, loss, injury, expense or inconvenience, which may be suffered, incurred, arise out of or in any way be connected to the rental. No term of this agreement is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to it. If the Property which the guest has booked becomes unavailable or unusable for an unforeseen reason prior to the date of booking, then YES’s obligations will be limited to using its best endeavours to find a suitable alternative property for the client, or, should this not be possible for whatever reason, reimbursing the guest for any monies paid in respect of the booking.

11. WARRANTIES

11.1 Whilst YES has taken all reasonable steps to ensure that the information contained on the website, advertising, tariffs and leaflets is correct, it reserves the right to alter, amend or withdraw any service facility or amenity without prior notice. YES does not warrant and takes no responsibility for the accuracy of any verbal information given or statements made by its employees or agents.

12. RIGHT OF ENTRY

12.1 The property owners shall be allowed the right of entry to the property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.

13. RIGHT TO REFUSE/TERMINATION

13.1 YES and the owner, acting on their own behalf or by their employees or agents reserve the right to terminate the Agreement and require, without refund, the immediate departure of all persons from the property in the event of a serious breach of the terms of the contract and these booking conditions. The breach may include but is not limited to any of the following events:
13.1.1 Serious damage to the property and grounds which may exceed the damage deposit;
13.1.2 Any criminal or illegal act;
13.1.3 As a result of abusive and unreasonable behaviour;
13.1.4 Excessive noise which could adversely affect the rights of YES or the owner to be able to continue to use the property for short term rentals or involve authorities or police in any form of complaint investigation.

14. INSURANCE

14.1 It is strongly recommended that the guest takes out a comprehensive travel insurance policy, which will include cancellation cover and full cover for the party’s personal belongings as no such cover is provided by YES or the owner including vehicles. Accordingly, any such losses incurred are the responsibility of the guest.

15. DATA PROTECTION

15.1 YES shall abide with the requirements of the 1998 Data Protection Act in respect of personal data. Unless required by law, information will not be shared with other organisations without your consent.
